C.Haines Classics is a trading name of a sole trader. The trader’s full legal name and business address should be added before these terms are published or issued to customers.
1. Definitions
In these Terms & Conditions:
-
“The Workshop”, “we”, “us” or “our” means C.Haines Classics.
-
“The Customer”, “you” or “your” means the individual or business instructing us to carry out work.
-
“The Vehicle” means any vehicle brought to us for inspection, repair, servicing, maintenance or restoration.
-
“The Work” means the services, labour, parts and associated work agreed between us and the Customer.
2. Acceptance of Terms
2.1 These Terms & Conditions apply to all work undertaken by C.Haines Classics unless otherwise agreed in writing.
2.2 By instructing us to carry out work, approving an estimate or quotation, paying a deposit, or authorising work to commence, the Customer agrees to these Terms & Conditions.
2.3 Any variation must be agreed in writing. Where the Customer is a business, any purchasing terms that conflict with these Terms & Conditions must be expressly accepted by us in writing.
2.4 Nothing in these Terms & Conditions affects statutory rights that cannot legally be excluded or restricted.
3. Estimates, Quotations and Pricing
3.1 Estimates are based on the information available and the condition of the Vehicle at the time of inspection. For older, classic or previously repaired vehicles, the full extent of work may not be apparent until dismantling or further investigation has taken place.
3.2 An estimate is not a fixed quotation unless expressly identified as such in writing.
3.3 If additional faults, corrosion, damage, deterioration or necessary work are discovered, we will explain the findings and provide an updated estimate where reasonably practicable. We will seek the Customer’s approval before undertaking additional chargeable work, except where an immediate step is reasonably necessary to protect the Vehicle or prevent further damage and we cannot reasonably obtain instructions.
3.4 Prices will be communicated before work is authorised. VAT will be charged where legally applicable and identified on the invoice.
3.5 Any estimated completion date is indicative unless a specific date has been expressly agreed in writing. Delays may arise from the condition of the Vehicle, the availability of parts, specialist services or other circumstances outside our reasonable control.
4. Deposits and Special-Order Parts
4.1 We may require a deposit before work commences or before ordering parts. The amount and payment terms will be confirmed to the Customer in advance.
4.2 Parts ordered specifically for a Vehicle may be non-returnable or subject to supplier restocking charges. Where a Customer cancels or changes an order, the Customer may be responsible for reasonable costs already incurred, subject to applicable consumer rights.
4.3 Any deposit deductions or cancellation charges will reflect applicable law and, where relevant, reasonable costs actually incurred. Deposits will not automatically be treated as non-refundable in every circumstance.
5. Completion and Timescales
5.1 We will use reasonable care and skill in carrying out the agreed work.
5.2 Completion dates are estimates unless expressly agreed otherwise in writing. We will info
6. Payment and Collection of Vehicles
6.1 Unless credit terms have been agreed in writing in advance, the full amount invoiced must be paid in cleared funds before the Vehicle is released or collected.
6.2 The invoice may include agreed labour, parts, materials, subcontracted services, VAT where applicable, and any other charges previously agreed with the Customer.
6.3 Accepted payment methods will be communicated by the Workshop. A payment instruction or screenshot is not confirmation that funds have cleared.
6.4 The Customer must arrange collection of the Vehicle once notified that it is ready. The Customer should contact us promptly if collection cannot take place within the period set out in Section 7.
6.5 We will not unreasonably refuse to release a Vehicle once the sums properly due for its release have been paid, subject to any lawful rights that may apply.
7. Storage Charges Following Completion
7.1 The Customer must collect the Vehicle within seven calendar days after we notify them that the agreed work is complete and the Vehicle is ready for collection.
7.2 If the Vehicle remains at the Workshop after that seven-day period, a storage charge of £50 per week, plus VAT where applicable, will apply from the eighth calendar day following notification.
7.3 We will make reasonable efforts to notify the Customer that storage charges are about to commence, including the date from which charges will apply. The Customer is responsible for ensuring that their contact details are accurate and for checking messages reasonably sent to those details.
7.4 Storage charges reflect the space and facilities required to retain the Vehicle after completion. They are separate from the agreed repair or restoration costs.
7.5 If the Vehicle cannot reasonably be collected because of a delay caused by us, or because collection is prevented by circumstances for which the Customer is not responsible, storage charges will not be applied for the affected period where it would be unfair or unlawful to do so.
7.6 Storage charges must be paid before collection, subject to applicable law and any genuine dispute about the charges. If the Customer disputes a charge, they should notify us promptly and explain the reason.
7.7 If the Vehicle remains uncollected for an extended period, we may contact the Customer to agree arrangements for its removal or continued storage. We will not assume an automatic right to sell or dispose of the Vehicle merely because it has not been collected.
8. Credit Terms and Late Payment
8.1 Credit is not available unless agreed in writing in advance. Any agreed credit terms will specify the applicable payment period.
8.2 For business customers, we reserve the right to claim statutory interest and eligible recovery costs on qualifying late commercial debts, where permitted by law.
8.3 For private customers, any interest or recovery costs will only be claimed where there is a lawful basis to do so and the relevant terms are fair and enforceable.
9. Vehicle Condition and Customer Responsibilities
9.1 The Customer must provide accurate information about the Vehicle, including known faults, previous repairs, modifications, warning lights, safety issues and any relevant history.
9.2 Classic and older vehicles may have pre-existing wear, corrosion, deterioration, obsolete components, previous repairs or hidden defects that cannot reasonably be identified before inspection or dismantling.
9.3 We will take reasonable care when inspecting, handling and working on the Vehicle. Where a pre-existing condition or hidden defect affects the proposed work, its cost, safety or likely outcome, we will explain this to the Customer when reasonably practicable.
9.4 The Customer should remove personal belongings and valuables before leaving the Vehicle with us. We cannot accept responsibility for items that were not declared or agreed for safekeeping, except where liability arises through our negligence or other legal responsibility.
9.5 The Customer must ensure that they are entitled to authorise work on the Vehicle and must tell us if they are acting on behalf of another owner, business, insurer or finance provider.
10. Work Authorisation and Additional Work
10.1 We will undertake the work agreed with the Customer. The Customer may approve work by signing an estimate, email, text message or another written method accepted by us.
10.2 If further work becomes necessary, we will seek approval before proceeding and confirm any material change to the estimated cost or timescale.
10.3 If we cannot contact the Customer, we may pause the work until instructions are received. Any resulting delay may affect the completion date.
10.4 We will not carry out unrelated additional work without authorisation, except where an immediate action is reasonably necessary to protect the Vehicle or prevent further damage and obtaining instructions is not reasonably practicable.
11. Parts and Removed Components
11.1 Parts may be new, reconditioned, refurbished, used or supplied by the Customer, depending on the work agreed. The type and condition of parts will be explained where relevant.
11.2 Where the Customer supplies parts, we cannot guarantee their quality, suitability or compatibility. If supplied parts are unsuitable or defective, additional labour, delay or replacement costs may arise. We will discuss these with the Customer before undertaking additional chargeable work.
11.3 Removed parts will be retained for the Customer only where this has been requested and agreed before the work is completed. Otherwise, parts may be disposed of or recycled appropriately, subject to any legal requirements.
11.4 Any warranty provided by a parts supplier will be subject to that supplier’s terms. This does not remove any rights the Customer may have against us under applicable law.
12. Vehicle Damage and Liability
12.1 We will take reasonable care of Vehicles while they are in our custody and control.
12.2 We are not responsible for pre-existing damage, defects or deterioration that we did not cause, or for faults that arise independently of our work. Where relevant, we may record the Vehicle’s visible condition on arrival.
12.3 We are not liable for loss or damage to the extent that it is caused by circumstances outside our reasonable control, or by the Customer’s actions or instructions, except where applicable law provides otherwise.
12.4 Nothing in these Terms & Conditions excludes or restricts liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or a consumer’s statutory rights.
12.5 For private customers, liability will not be excluded or restricted in a way that is prohibited by consumer protection law. For business customers, any lawful limitation of liability must be expressly agreed in writing and must satisfy applicable legal requirements.
13. Waste and Environmental Compliance
13.1 We will handle and dispose of waste arising from our work in accordance with applicable environmental and waste requirements.
13.2 Where a Customer asks us to retain or return removed parts, this must be agreed in advance and may be subject to practical or legal restrictions.
14. Complaints and Disputes
14.1 If the Customer has a concern about the work, invoice, Vehicle condition or storage charges, they should contact us as soon as possible and provide relevant details.
14.2 We will review the concern and aim to resolve it fairly and promptly. Where necessary, we may ask to inspect the Vehicle or the relevant work.
14.3 Nothing in this clause limits the Customer’s legal rights or prevents either party from pursuing a lawful remedy.
15. Data Protection
15.1 We will use the Customer’s personal information to manage enquiries, estimates, bookings, repairs, invoices, payments and related administration.
15.2 We will handle personal information in accordance with applicable data protection law and our privacy information, which should be made available to Customers separately.
16. Governing Law
16.1 These Terms & Conditions are governed by the law of England and Wales, unless another mandatory legal provision applies.
16.2 Any dispute will be dealt with by the courts with appropriate jurisdiction, subject to any mandatory rights that apply to the Customer.
17. Cancellation and Work Not Proceeding
17.1 If the Customer decides not to proceed after work has been authorised, they must notify us as soon as possible.
17.2 The Customer may be liable for work already carried out, parts ordered, services commissioned and reasonable costs properly incurred before cancellation, subject to the agreed terms and applicable law.
17.3 Any cancellation charge must be fair, proportionate and legally enforceable. Consumer cancellation rights, including any applicable rights for contracts made at a distance or away from business premises, will be respected.
17.4 Where work cannot proceed because of an issue with the Vehicle, unavailable parts or another material complication, we will explain the position and discuss the available options with the Customer.
18. Agreement
By authorising work, the Customer confirms that they have had the opportunity to read these Terms & Conditions and understand that they apply to the work agreed with C.Haines Classics.
